Notification of Employee Rights under the National Labor Relations Act (NLRA)

Following much debate and even some lawsuits, all private sector employers are required to add a posting to their workplaces by April 30, 2012. The latest posting requirement comes from the National Labor Relations Board (NLRB), the federal agency responsible for enforcing federal laws protecting the rights of employees to form or join unions, as outlined in the National Labor Relations Act (NLRA). The required posting must advise employees of their right to organize and engage in other protected concerted activity, or to refrain from engaging in such activity.

Here’s what your company has to do to be in compliance with this new regulation:

  1. If you are a Genesis client you will automatically receive revised labor law postings when state or federal changes require an update.
  2. If you are not a client, be sure to get copies of the required notice from the NLRB website at www.nlrb.gov/poster.
  3. Put the new posting in a conspicuous place, where other notifications of workplace rules are posted.
  4. Offer this Employee Rights notice electronically if you maintain an Intranet, or other electronic posting source.
  5. Get it done on time and be aware that an employer’s failure to post the notice could be used as evidence of hostility toward union activities.
